The Government of the National Capital Territory of Delhi Services Bill, 2023, was introduced in Lok Sabha by the Centre. The Bill aims to repeal the National Capital Territory of Delhi (Amendment) Ordinance, 2023, which governs the control of services in the city. While the opposition attacked the government, alleging that the bill aims to take away the powers of the Delhi Assembly, Union Home Minister Amit Shah, who was present in the House, said, “All objections raised are political, and do not have any constitutional basis.”

- Opposition Parties Said The Bill Is “A Clear Violation Of The Constitution”, As Article 239 Provides Powers To The Delhi Assembly To Make Laws On Subjects Mentioned In The State List And Concurrent List. The Bill Gives More Powers To The Lieutenant Governor Of Delhi.
- This Raises Serious Questions About The Centre’s View Of Ignoring The Supreme Court And The Constitution. This Bill Aims At Undermining The Independence And Rights Of Delhi Government, Which Was Established By The Supreme Court Judgment.

- The Ordinance, Promulgated By President Murmu On May 19, Sought To Amend The Government Of NCT Of Delhi Act, 1991 Effectively Negating The May 11 SC Judgement That Gave AAP Govt The Power To Make Laws And Wield Control Over Bureaucrats Deputed To The Delhi Government.
- Firstly, The Bill, Mandates The Creation Of An Authority For Transfers And Postings Of Senior Officers In The Delhi Government. Secondly, It Also Empowers The L-G To Appoint The Heads Of Boards Or Commissions That Are Enacted By the Delhi Legislative Assembly.

- The National Capital Civil Service Authority (NCCSA) Shall Have The Responsibility To Recommend The Transfers And Postings Of All Group ‘A’ Officers (IAS) And Officers Of DANICS Serving In The Delhi Government.
- NCCSA Shall Consist Of:
- Chief Minister Of Delhi, Who Shall Be The Ex-officio Chairperson Of The Authority.
- The Chief Secretary Of Delhi, Who Will Function As a Member And The
- Principal Home Secretary, Delhi, Who Shall Be The Member-Secretary.
- All Matters Required To Be Decided By The Authority Shall Be Decided By Majority Of Votes Of The Members Present And Voting.
